Calm Down Now Terms of Use

These Terms of Use ("Terms") are an agreement between you and Calm Down Now LLC, a Florida limited liability company ("Calm Down Now", "we", "us"). They govern your use of the Calm Down Now mobile application, our website at calmdownnow.com, and any content or features we offer through them (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can use the Service

You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the permission of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed at children under 13, and we do not knowingly collect information from them.

2. Your account

You need an account to use the app. You can sign in with Apple, with Google, or with an email link. You are responsible for keeping access to your account secure and for everything that happens under it. Tell us at info@calmdownnow.com if you think someone else has used your account.

You can delete your account at any time from the Profile tab. Deleting your account removes your sign-in and the profile information we hold. Content stored only on your device, such as your journal, is removed when you delete the app.

3. What Calm Down Now is, and is not

Calm Down Now offers guided audio, relaxing sounds, breathing and grounding exercises, self-help techniques, and a private journal, created to support relaxation and everyday stress relief. The guided audio is narrated by June Tomaso-Wood, LCSW.

Calm Down Now is not medical care. It is not a substitute for diagnosis, treatment, or advice from a physician, therapist, or other qualified professional, and it does not create a therapist-client relationship between you and June Tomaso-Wood or anyone at Calm Down Now. If you have a medical or mental health condition, talk to your provider before relying on any technique in the app. Never disregard professional advice or delay seeking it because of something in the Service.

The Service is not for emergencies. If you are in crisis, are thinking about harming yourself, or need immediate help, call your local emergency number or a crisis line right away.

Use it safely. Do not listen to guided audio or use breathing exercises while driving, operating machinery, or doing anything that requires your full attention. Stop any exercise that causes discomfort, dizziness, or distress.

No promise of results. We do not represent or guarantee that any audio, exercise, or technique in the Service will produce any particular medical, psychological, physical, or emotional result for you.

About the techniques. The tapping technique in the app draws on Emotional Freedom Techniques (EFT). The Service is not sponsored by, endorsed by, or affiliated with Gary Craig, the founder of EFT, and he bears no responsibility for the Service. The Unblocking Energy Flow technique draws on principles of Jin Shin Jyutsu®. The Service is not sponsored by, endorsed by, or affiliated with Jin Shin Jyutsu, Inc. or the estate of Mary Burmeister, and they bear no responsibility for the Service. Jin Shin Jyutsu is a trademark of its owner.

4. Free content and Premium

Part of the Service is free for everyone, including the Stop Panic Now audio. Other content and features require a Premium subscription or a lifetime purchase ("Premium"). What is included in Premium may change over time as we add, update, or retire content.

4.1 Subscriptions

Premium subscriptions are sold through Apple's App Store and billed to your Apple Account. Prices are shown in the app before you buy and may vary by country.

  • Free trial. New subscribers may be offered a free trial. Unless you cancel at least 24 hours before the trial ends, your subscription begins and you are charged the price shown.
  • Automatic renewal. Subscriptions renew automatically at the end of each period (monthly or yearly) unless you cancel at least 24 hours before the current period ends.
  • Cancelling. You cancel through your Apple Account settings (Settings, then your name, then Subscriptions), not through us. Cancelling stops future charges; you keep Premium until the end of the period you already paid for.
  • Refunds. Because Apple handles billing, refund requests go to Apple under Apple's refund policy. We cannot issue refunds for App Store purchases ourselves.
  • Price changes. If we change the price of a subscription, Apple will tell you in advance and, where required, ask for your consent before the new price applies.

4.2 Lifetime access

Lifetime access is a one-time purchase that unlocks Premium for as long as Calm Down Now is available on the App Store, with no recurring charges. It is tied to your Apple Account, is not transferable, and cannot be exchanged for cash. If we ever discontinue the app, lifetime access ends when the app is no longer available. We will give reasonable notice before that happens, but lifetime access does not entitle you to any refund beyond what Apple's policies provide.

4.3 Original purchasers

If you bought the original paid version of Calm Down Now before this version launched, the classic guided audio and relaxing sounds from that version remain available to you at no charge on the same Apple Account. This is determined automatically from your App Store purchase record. We may also offer original purchasers a reduced price for lifetime access; any such offer is made in the app and may be withdrawn at any time.

4.4 Restoring purchases

If you reinstall the app or change devices, use Restore Purchases in the app while signed in to the same Apple Account you bought with.

5. Your licence to use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app and its content for your own non-commercial wellbeing. You may not:

  • copy, record, download, extract, redistribute, publicly perform, or sell any audio, text, images, or other content from the Service;
  • use the Service or its content to train an artificial intelligence model or to build a competing product;
  • reverse engineer, decompile, or tamper with the app, or bypass any feature that controls access to Premium content;
  • use the Service in a way that violates any law or these Terms.

All content in the Service, including June Tomaso-Wood's recordings, scripts, techniques, artwork, and software, is owned by Calm Down Now LLC or its licensors and protected by copyright and other laws. Calm Down Now is a trademark of Calm Down Now LLC. Nothing in these Terms gives you any right to our trademarks or content beyond the licence above.

6. Your content

Anything you write in the journal or save in the app belongs to you. Journal entries are stored on your device and are not sent to us. We do not read, collect, or use them. If you send us feedback or suggestions, you agree that we may use them without any obligation to you.

7. Apple Health, Siri, and notifications

If you choose to connect Apple Health, the app records your mindful minutes to the Health app on your device. We cannot read your Health data. If you use Siri or Home Screen shortcuts, your request is handled by Apple and the app on your device. Reminder notifications are scheduled on your device and can be turned off in the Profile tab at any time.

8. Changes to the Service

We are always improving Calm Down Now. We may add, change, or remove content and features, and we may stop offering the Service altogether. Where a change materially reduces what a paid subscription includes, you may cancel and Apple's refund policy will apply.

9. Ending your use

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or if we are required to by law. Sections 5, 6, and 10 through 14 survive termination.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or that any technique will produce a particular result for you.

11. Limitation of liability

To the fullest extent permitted by law, Calm Down Now LLC, its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us through the Service in the twelve months before the claim or one hundred US dollars.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to indemnify and hold Calm Down Now LLC harmless from claims, losses, and reasonable legal fees arising from your breach of these Terms or your misuse of the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. If you have a problem, please email us first at info@calmdownnow.com; most issues can be resolved informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. If you live outside the United States, you may also have rights under the consumer protection laws of your own country that these Terms do not take away.

14. Terms that apply because you got the app from Apple

These Terms are between you and Calm Down Now LLC, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price you paid for the app, if any; Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, consumer protection claims, or intellectual property claims. You represent that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when using the app, such as your wireless carrier's terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will tell you in the app or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. The current version is always at calmdownnow.com/terms.

16. General

These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of our business.
